BELAY

Terms & Conditions

Effective 6 October 2026. Operated by Second Ascent LLC (“Belay”, “we”, “us”).

  • Privacy Policy
  • Terms & Conditions
  • Cookie Policy
  • Refund & Cancellation Policy

These are the terms of the deal between you and Second Ascent LLC for the Belay service. Creating an account means you accept them.

1. Who we are, and who you must be

Belay is operated by Second Ascent LLC, a limited liability company formed in Wyoming, at 30 N Gould St, Ste R, Sheridan, WY 82801. You must be at least 18 and able to enter a contract. You need a US mobile number that can receive SMS; the service cannot text numbers outside the United States.

2. What the service is

Belay sends you scheduled text messages about training sessions you have told it about, reads your replies, and moves sessions in its own schedule when you miss them. That is the whole of it. There is no app to install and no dashboard you are required to open.

3. Belay is not a coach, a doctor, or a trainer

Read this one. Belay is software. There is no human coach on the other end. It does not design training programmes, does not tell you what to lift or how to lift it, and gives no medical, nutritional, or physiotherapeutic advice. It only asks whether you trained and reschedules what you missed.

Exercise carries a risk of injury. You are responsible for deciding whether you are fit to train and for how you train. Talk to a doctor before starting or changing a training programme, particularly if you have an injury, a medical condition, or are pregnant. Nothing Belay sends you is medical advice, and you should never delay or disregard advice from a qualified professional because of something Belay texted you. If you think you are having a medical emergency, call 911. Belay does not monitor incoming messages in real time and cannot help in an emergency.

4. What it costs

A 3-day free trial, then $14 per month, charged automatically to the card you provide, until you cancel. Your card is collected at signup and is not charged during the trial. We send you a text roughly 12 hours before the first charge. Prices are in US dollars and exclude any tax we are required to collect. If we change the price, we will tell you at least 30 days beforehand and you can cancel before it applies.

Cancellation, pausing, and refunds are in the Refund & Cancellation Policy, which forms part of these terms.

5. Messages, and your consent to them

You are giving express written consent to receive automated coaching text messages at the number you provide. They come from Belay, an AI coach rather than a person, and cover your training sessions: reminders, check-ins and rescheduling. This consent is not a condition of purchase in any sense beyond the obvious one: the service is text messages, so withdrawing consent ends the usefulness of the subscription. Up to 2 messages per day, plus replies to your texts. Message and data rates from your carrier may apply.

Reply STOP to stop the messages, START to resume, and HELP for help. Reply PAUSE to hold everything and be charged nothing, and RESUME when you want it back. We do not guarantee delivery of any individual message: carriers, filtering, and your own signal are outside our control.

6. Your account

Keep your password to yourself; you are responsible for what happens under your account. Give us accurate information, particularly your phone number — texting a number you do not control is a problem for whoever does control it. One person per account. Tell us at support@startbelay.com if you think someone else is in your account.

7. What you agree not to do

  • Use Belay for anything illegal, or to harass, threaten, or abuse anyone.
  • Enter someone else's phone number, or any number you are not entitled to consent on behalf of.
  • Try to break, overload, reverse-engineer, or scrape the service.
  • Resell, sublicense, or rebrand Belay.
  • Impersonate anyone, or misrepresent your age.

We can suspend or close an account that does any of these, or that we reasonably believe puts other users or our carrier registration at risk. Where we can, we will say why first.

8. Who owns what

We own Belay: the software, the name, the mark, the wording of the site. You get a personal, non-transferable, revocable licence to use the service while you are paying for it, and nothing more.

You own what you tell it. Your training profile, your replies, your history — yours. You grant us only the licence we need to run the service for you: to store that content, process it, and pass the parts listed in the Privacy Policy to the four sub-processors named there. We do not use your content to train any AI model, and we do not license it to anyone else.

9. The service is provided as it is

To the fullest extent the law allows, Belay is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, that every message will arrive, or that it will produce any particular result for your training. Some states do not allow these exclusions, in which case they apply to you only as far as that state permits.

10. Limits on what we owe you

To the fullest extent the law allows, neither we nor anyone working with us is liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or personal injury arising from how you chose to train.

Our total liability to you for any claim is capped at the greater of the amount you actually paid us in the twelve months before the claim, or $100.

Nothing here excludes liability that cannot lawfully be excluded, including for fraud, for our own gross negligence or wilful misconduct, or for death or personal injury caused by our negligence.

11. You cover claims you cause

If someone brings a claim against us because you broke these terms, misused the service, or gave us a phone number that was not yours to give, you will cover our reasonable costs and losses from it.

12. Ending it

You can cancel at any time — by text, or from Settings — and can delete your account and data whenever you like. We can end or suspend the service, with notice where it is practical to give it. Sections 8 through 13 survive the end of this agreement.

13. Law, and how disputes get resolved

These terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules.

Talk to us first. Email support@startbelay.com and give us 30 days. Most things end there.

If they do not: any dispute that cannot be settled informally will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in Wyoming or by video or telephone at your election. You and we each waive the right to a jury trial and to participate in a class action. Either of us may still bring an individual claim in small-claims court instead.

You can opt out of arbitration. Email support@startbelay.com with the subject “Arbitration opt-out” within 30 days of first accepting these terms. That is the whole procedure. Opting out costs you nothing and changes nothing else about your account.

If the class-action waiver is held unenforceable, the whole of the arbitration agreement in this section falls away and disputes go to the state or federal courts located in Wyoming.

14. The rest

These terms, with the Privacy Policy, Cookie Policy and Refund Policy, are the entire agreement between us. If a clause is unenforceable, the rest stands. Not enforcing something once does not waive it. You may not transfer your account; we may transfer this agreement if the business is sold, and will tell you if that happens. We will give at least 30 days' notice of any material change to these terms.
